Annual, maternity and paternity leave in Indonesia, including for contract workers

Workers in Indonesia earn annual leave after 12 months and paid maternity leave. The rules for contract staff, leave for fathers, and unused leave.

How many days of annual leave do workers get in Indonesia?

Annual leave in Indonesia is at least 12 working days, and the employer must give it after the worker has worked 12 months continuously (Law 13/2003, Article 79(3), as amended by Law 6/2023). How it is taken is set in the employment contract, company regulation or collective agreement (Article 79(4)). You are entitled to full pay during annual leave (Article 84). Employers may give more than 12 days, and certain companies may give long-service leave (Article 79(5)).

How long is maternity leave in Indonesia?

Maternity leave in Indonesia is counted in months. Article 82(1) of Law 13/2003 gives 1.5 months of rest before and 1.5 months after giving birth, as calculated by an obstetrician or midwife. Law 4/2024 on Mother and Child Welfare, in force since 2 July 2024, sets maternity leave at a minimum of the first 3 months and up to 3 more months if special conditions are certified by a doctor (Article 4(3)(a)). Special conditions are health problems or complications of the mother or the baby (Article 4(5)). Employers must grant this leave (Article 4(4)).

Is salary paid during maternity leave in Indonesia?

Yes. Article 84 of Law 13/2003, as amended by Law 6/2023, gives full pay during maternity rest. Article 5(2) of Law 4/2024 sets the pay in detail: full pay for the first 3 months and the fourth month, then part of the wage for the fifth and sixth months; the shares are in the table below. A mother on maternity leave may not be dismissed and keeps her rights (Article 5(1)). If she is dismissed or her rights are not met, the central or regional government provides legal aid (Article 5(3)).

Is there paternity leave in Indonesia?

Yes. A husband is entitled to leave to accompany his wife at childbirth for 2 days, which can be extended by up to 3 more days or by agreement (Law 4/2024, Article 6(2)(a)). If his wife miscarries, the leave is 2 days (Article 6(2)(b)). He is also given enough time if the mother or baby has health problems or complications, or if the mother or baby dies (Article 6(3)). Article 93(4) of Law 13/2003 keeps wages paid for 2 days when a wife gives birth or miscarries.

Do contract workers get leave in Indonesia?

Article 79 of Law 13/2003 does not distinguish permanent and fixed-term (PKWT) workers: annual leave is due to workers who have worked 12 months continuously. A contract worker with less than 12 months of service does not yet meet that condition, unless the contract or company regulation gives more. Other rights do not depend on length of service, such as maternity and paternity leave under Law 4/2024, menstrual rest on the first and second day, and paid leave for marriage or a death in the family.

Can unused annual leave be paid out?

When employment ends, annual leave not yet taken and not yet lapsed is part of the compensation for rights that must be paid (Government Regulation 35/2021, Article 40(4)(a)). This applies to dismissal and to resignation (Article 50). While you are still employed, the law does not require unused leave to be paid out; whether it can be paid, carried over or lapse is set in the employment contract, company regulation or collective agreement (Law 13/2003, Article 79(4)). Is there paid menstrual leave and sick leave in Indonesia?

Yes. A woman who feels pain during menstruation and tells her employer does not have to work on the first and second day (Law 13/2003, Article 81), and her wages are still paid (Article 93(2)(b)). A worker who is too ill to work is also paid (Article 93(2)(a)). For long illness, the share of wages paid falls every 4 months until the employment ends (Article 93(3)); the shares are in the table below. Ask for a doctor's letter as proof.

How many paid days off for marriage or a death in the family?

Article 93(4) of Law 13/2003 keeps wages paid when a worker is absent because of: their own marriage, 3 days; a child's marriage, 2 days; a child's circumcision, 2 days; a child's baptism, 2 days; a wife giving birth or miscarrying, 2 days; the death of a spouse, parent, parent-in-law, child or child-in-law, 2 days; and the death of a household member, 1 day. Law 6/2023 did not amend this article. A contract or company regulation may give more.

How much is paid during maternity leave?

Pay during maternity leave is set by Article 5(2) of Law 4/2024. Months four to six apply only when the leave is extended for special conditions certified by a doctor.

How much is paid during a long illness?

Pay during a long illness falls in steps under Article 93(3) of Law 13/2003, which Law 6/2023 did not amend. The count starts when the worker becomes unable to work because of illness.

What can I do if my employer refuses leave?

Refusing mandatory annual leave breaches Article 79(1) to (3) of Law 13/2003, which carries a criminal fine under Article 187 as adjusted by Law 1/2026. Start by asking for leave in writing and keeping the reply. If it is refused without grounds, negotiate in a bipartite meeting, then register a rights dispute with Disnaker for mediation. Frequently asked questions

Can I be dismissed for being pregnant or taking maternity leave?

No. Article 153(1)(e) of Law 13/2003, as amended by Law 6/2023, bans dismissing a woman because she is pregnant, gives birth, miscarries or breastfeeds. Article 5(1) of Law 4/2024 also states that a mother on maternity leave may not be dismissed and keeps her rights.

Is maternity leave in Indonesia 3 months or 90 working days?

The law counts it in months, not working days. Article 82 of Law 13/2003 gives 1.5 months of rest before and 1.5 months after giving birth, and Article 4(3) of Law 4/2024 sets maternity leave at a minimum of the first 3 months. Neither law mentions 90 working days.

Is there leave after a miscarriage?

Yes. A woman who has a miscarriage is entitled to 1.5 months of rest or the period in a letter from a doctor, obstetrician or midwife (Law 13/2003, Article 82(2), and Law 4/2024, Article 4(3)(b)). Her husband is entitled to 2 days of leave (Law 4/2024, Article 6(2)(b)).

Do these rules apply to civil servants, the military and the police?

Not fully. Article 10 of Law 4/2024 says maternity leave, pay during leave and paternity leave for civil servants (ASN), the military (TNI) and the police (Polri) follow their own regulations. This page covers employees of private companies and state-owned enterprises under the Manpower Law.
