What does Manpower Regulation 6/2016 cover?
Minister of Manpower Regulation 6/2016 on the Religious Holiday Allowance for Workers in Companies was signed and promulgated on 8 March 2016 (State Gazette 2016 No. 375). It sets who is entitled to THR, how the amount is calculated, when and in what form THR is paid, the late-payment fine, sanctions and inspection. It repealed Regulation PER.04/MEN/1994 (Article 12) and, according to the BPK legal database, is still in force.

How large is the late fine under Article 10?
Article 10(1) fines an employer that pays THR late, calculated on the total THR due from the end of the payment deadline. PP 36/2021 Article 62(1) says the same. The rate is shown from the data below, with its sources. An employer that does not pay THR at all faces administrative sanctions (Article 11), which PP 36/2021 Article 79 applies in stages, from a written warning up to suspension of business activities.

What has changed since Manpower Regulation 6/2016 was issued?
The core rules have not changed, but they now also appear in PP 36/2021 on Wages: THR is non-wage income that must be paid at least 7 days before the holiday (Articles 8 and 9), and the details are left to a ministerial regulation (Article 9(3)). Each year the Minister of Manpower also issues a circular on paying THR. For 2026, circular M/3/HK.04.00/III/2026 was signed on 2 March 2026, stated that THR must be paid in full without instalments, and asked every region to open a THR complaint post.

Where does the late THR fine go?
The late THR fine is managed and used for the workers' welfare, as set out in the company regulation or collective agreement (Manpower Regulation 6/2016 Article 10(3)). The fine does not cancel the employer's duty to pay THR (Article 10(2)).
Is Manpower Regulation 6/2016 still in force after PP 36/2021?
Yes. The BPK legal database records Manpower Regulation 6/2016 as in force. PP 36/2021 Article 9(3) leaves the details of THR to a ministerial regulation, and the BPK database lists no regulation that repealed Manpower Regulation 6/2016.
