THR religious holiday allowance in Indonesia: who gets it, how much and where to report

THR is owed to workers with 1 month or more of service, contract staff included, 7 days before the holiday at the latest. How to calculate it and report.

Who is entitled to THR?

Every worker with 1 month or more of continuous service is entitled to the religious holiday allowance (THR), whether on an open-ended (permanent) or fixed-term (PKWT) contract, under Manpower Regulation 6/2016 Article 2. THR follows the worker's own religious holiday: Eid al-Fitr, Christmas, Nyepi, Vesak or Chinese New Year (Article 1, point 2). PP 36/2021 on Wages confirms THR as non-wage income the employer must pay (Articles 8 and 9(1)).

How is THR calculated, including pro rata THR?

Workers with 12 months or more of continuous service receive 1 month's wage. Workers with 1 month to under 12 months receive pro rata THR: their months of service divided by 12, times 1 month's wage (Manpower Regulation 6/2016 Article 3(1)). One month's wage is the clean wage without allowances, or the basic wage plus fixed allowances (Article 3(2)). For casual daily workers, it is the average wage of the last 12 months, or the average monthly wage over the period worked if under 12 months (Article 3(3)). If the employment contract, company regulation, collective agreement or custom gives more, the larger amount applies (Article 4).

When must THR be paid?

THR must be paid at least 7 days before the religious holiday (Manpower Regulation 6/2016 Article 5(4) and PP 36/2021 Article 9(2)). It is paid once a year for each worker's own holiday, unless the employment contract, company regulation or collective agreement says otherwise (Article 5(1) to (3)). For THR 2026, Minister of Manpower circular M/3/HK.04.00/III/2026, signed on 2 March 2026, stated that THR must be paid in full and may not be paid in instalments.

When is THR for 2027 due?

The rule stays the same: 7 days before the holiday (Manpower Regulation 6/2016 Article 5(4)). The joint ministerial decree (SKB) on 2027 public holidays and collective leave, issued on 15 September 2026, lists Eid al-Fitr 1448 H on 10 and 11 March 2027, but the exact date is set by a decision of the Minister of Religious Affairs (its second clause). So the 2027 Eid THR deadline is counted back 7 days from the holiday as finally set. We add the year's THR circular to this page once it is issued; the 2026 circular was signed on 2 March 2026.

If I resign before Eid, do I still get THR?

It depends on when you leave. As long as you are still employed on the payment deadline, 7 days before the holiday, THR must be paid (Manpower Regulation 6/2016 Articles 2 and 5(4)). If you resign before that deadline, the regulation does not guarantee THR for that holiday: Article 7 protects only permanent workers dismissed by the employer within 30 days before the holiday. Your employment contract, company regulation or collective agreement may give more, so check them before you resign.

Do workers dismissed shortly before the holiday still get THR?

Permanent (PKWTT) workers dismissed within 30 days before the holiday are still entitled to THR for the current year (Manpower Regulation 6/2016 Article 7(1) and (2)). This does not apply to fixed-term (PKWT) workers whose contract ends before the holiday (Article 7(3)). Workers transferred to another company with continuous service are entitled to THR at the new company if the old one has not paid it (Article 8).

What happens if THR is late or not paid?

An employer that pays THR late is fined a share of the total THR due, counted from the deadline onwards; the rate is in the late-fine table below. The fine does not cancel the duty to pay THR (Manpower Regulation 6/2016 Article 10 and PP 36/2021 Article 62). An employer that does not pay THR faces administrative sanctions (Manpower Regulation 6/2016 Article 11), which PP 36/2021 Article 79 applies in stages: a written warning, restrictions on business activities, temporary suspension of some or all production equipment, and suspension of business activities.

Where can I report THR that is unpaid or only half paid?

First, ask for your THR in writing from your employer. For 2026 the Minister of Manpower's circular stated THR must be paid in full and not in instalments, so THR paid only in part can also be reported. If that does not resolve it, report it to the Ministry of Manpower's THR post at poskothr.kemnaker.go.id or to the THR post at your regional labour office. Have the company's name and address, your length of service, job title, and evidence such as your contract or payslips ready. If THR is still not paid, the rights dispute can go to mediation at the district or city labour office (Law 2/2004 Articles 4 and 8).

Are domestic workers entitled to THR?

Yes. Law 2/2026 on the Protection of Domestic Workers, in force since 30 April 2026, gives domestic workers the right to a religious holiday allowance in money as agreed or set in their work agreement (Article 15(1)(f)), and the employer must pay it (Article 19). Do THR rules change under the new labour law?

No change is in force yet. The DPR and the Government approved the Labour Protection Law on 6 October 2026, but it has not been promulgated and its text is not public, and the Ministry of Manpower's official summary does not mention THR changes. Until a new rule takes effect, THR follows Manpower Regulation 6/2016 and PP 36/2021.

How much is the fine for late THR?

The late THR fine is a share of the total THR due, counted from the moment the deadline of 7 days before the holiday has passed. The rate is set by Manpower Regulation 6/2016 Article 10(1) and PP 36/2021 Article 62(1). The fine goes to workers' welfare and does not replace your THR; the employer must still pay THR in full.

Frequently asked questions

Do contract workers on 3 or 6 months get THR?

Yes, if the contract is still running when THR falls due. Fixed-term (PKWT) workers with 1 month or more of continuous service are entitled to THR (Manpower Regulation 6/2016 Article 2). Because their service is under 12 months, it is pro rata: months of service divided by 12, times 1 month's wage (Article 3(1)(b)). So 3 months of service earns 3/12 and 6 months earns 6/12 of 1 month's wage.

My contract ends a week before Eid. Do I get THR?

Not for that holiday. Article 7(3) of Manpower Regulation 6/2016 says fixed-term (PKWT) workers whose contract ends before the holiday are not entitled to THR. This differs from permanent (PKWTT) workers dismissed within 30 days before the holiday, who remain entitled (Article 7(1)).

Can THR be given as a gift hamper or groceries?

No. THR is paid in money, in Indonesian rupiah (Manpower Regulation 6/2016 Article 6). A company may give hampers as well, but they do not replace THR.

Are non-fixed allowances included in THR?

No, unless your employer gives more. The one month's wage used for THR is the wage without allowances, or the basic wage plus fixed allowances (Manpower Regulation 6/2016 Article 3(2)). Non-fixed allowances are not part of the base under that article. If the employment contract, company regulation, collective agreement or custom gives a larger THR, the larger amount applies (Article 4).
