How do I hand in the letter so there is proof?

Deliver the letter in a way that leaves proof: ask the recipient to sign the receipt section on your copy, or send it to the company's official email address and keep the sent email.     Manpower Minister Circular M/5/HK.04.00/V/2025 of 20 May 2025 states that employers are prohibited from requiring or holding workers' original diplomas and personal documents as security for employment (point 1). The only exception is a diploma or competency certificate from education or training paid for by the employer under a written employment agreement, and the employer must keep it safe and compensate the worker if it is damaged or lost (point 4). Some legal commentary points to an old rule in the Civil Code (KUH Perdata), but we have not checked its official text or its standing after Law 13/2003.     Government Regulation 35/2021 provides that a dismissal notice is given as a letter no later than 14 working days before the dismissal (Article 37(3)). A worker who rejects it must make a written rejection with reasons within 7 working days of receiving the notice (Article 39(1)); the disagreement is then settled through a bipartite negotiation (Article 39(2)) and, if there is no agreement, through the industrial relations dispute mechanism (Article 39(3)). If the worker does not reject it, the employer reports the dismissal to the ministry or the manpower office (Article 38). Law 6/2023 Article 81 point 40 (Article 151(3) of Law 13/2003) also requires a bipartite negotiation when the worker rejects the dismissal. Constitutional Court decision 168/PUU-XXI/2023 (31 October 2024) reads that negotiation as deliberation to reach agreement, and holds that if it fails, a dismissal may only take place after a final and binding decision of an industrial relations dispute body. Termination rights are severance pay and/or long-service pay and compensation for rights (Government Regulation 35/2021 Article 40(1)); estimate them with the severance calculator.

    Law 2/2004 Article 3 requires an industrial relations dispute to be settled first through a bipartite negotiation by deliberation to reach agreement, within 30 working days of the start of the negotiation; if one party refuses to negotiate or no agreement is reached, the bipartite stage is deemed to have failed (Article 3(1) to (3)). Every negotiation is recorded in minutes (risalah) signed by the parties (Article 6). If the bipartite stage fails, the dispute is registered at the local manpower office with proof of the bipartite effort (Article 4(1)). Ministerial Regulation PER.31/MEN/XII/2008 adds that if a written invitation has been sent 2 times in a row and was refused or not answered, the dispute may be registered with proof of those invitations (Article 3(2)), and that a worker who is not a union member may authorise the union officials in the company to accompany them (Article 4(1)(a)(2)).

What goes into the minutes of a bipartite negotiation?

Law 2/2004 Article 6 requires minutes (risalah) of every bipartite negotiation, signed by the parties, containing at least the full names and addresses of the parties, the date and place, the main issue, the opinions of the parties, the conclusion or result, and the date and signatures. Ministerial Regulation PER.31/MEN/XII/2008 Article 4(1)(b)(7) adds that if a party will not sign, this is recorded in the minutes.
