Overtime pay in Indonesia: hour limits, how to calculate it and your rights

Overtime in Indonesia is capped at 4 hours a day and 18 a week, needs your consent, and is paid with multipliers of the hourly wage (1/173 of monthly pay).

What are the daily and weekly overtime limits?

Overtime may last at most 4 hours a day and 18 hours a week, under PP 35/2021 Article 26 and Law 13/2003 Article 78(1) as amended by Law 6/2023. The limit does not count overtime on weekly rest days or public holidays. Overtime is work beyond normal working time, which is 7 hours a day and 40 hours a week for a 6-day week, or 8 hours a day and 40 hours a week for a 5-day week (PP 35/2021 Article 21). Certain sectors may use working-time arrangements set by the Minister (Articles 23 and 30).

How is overtime calculated per hour?

Overtime is always calculated from the hourly wage, which is 1/173 of the monthly wage (PP 35/2021 Article 32(2)). If your pay consists of a basic wage and fixed allowances, the whole amount is the basis. If there are also variable allowances, and the basic wage plus fixed allowances is less than three quarters of total pay, the basis is three quarters of total pay (Article 32(3) and (4)). For daily-paid workers, the monthly wage is the daily wage times 25 for a 6-day week, or times 21 for a 5-day week (Article 33(1)). For piece-rate workers, it is the average of the last 12 months and may not be below the minimum wage (Article 33(2) and (3)).

How much is 2, 3 or 4 hours of overtime on a working day?

On a working day, the first overtime hour is paid at 1.5 times the hourly wage, and each following hour at 2 times the hourly wage (PP 35/2021 Article 31(1)). If your monthly wage is U, your hourly wage is U/173. Two hours of overtime pays 1.5 + 2 = 3.5 x U/173. Three hours pays 1.5 + 2 + 2 = 5.5 x U/173. Four hours, the daily limit, pays 1.5 + 2 + 2 + 2 = 7.5 x U/173.

What other rights do I have when working overtime?

Besides overtime pay, the company must give you enough rest. If overtime lasts 4 hours or more, the company must provide food and drink of at least 1,400 kilocalories, and this cannot be replaced with money (PP 35/2021 Article 29). An employer that breaches the rest and food duties can face staged administrative sanctions, from a written warning up to suspension of business activities (Article 61).

Who is not entitled to overtime pay?

Workers in certain job grades can be excluded: those responsible as thinkers, planners, executors or controllers of the company, whose working time cannot be limited and who receive higher pay (PP 35/2021 Article 27(2) and (3)). These job grades must be set out in the employment contract, company regulation or collective agreement. If they are not, the employer must still pay overtime (Article 27(5)). Being on a fixed-term contract or holding an ordinary staff title is not a reason to withhold overtime pay.

What can I do if my overtime is not paid?

Record the dates and hours of your overtime, and keep the overtime instructions, any overtime list you signed, and your payslips. Ask the employer in writing for payment; this bipartite negotiation must be tried first and last at most 30 working days (Law 2/2004 Article 3). If it fails, register a rights dispute with the district or city labour office for mediation (Articles 4 and 8). You can also complain to labour inspectors at the Ministry of Manpower or the provincial labour office (PP 35/2021 Article 60).

Do overtime rules change under the new labour law?

Not yet. The DPR and the Government approved the Labour Protection Law on 6 October 2026, but it has no number, has not been promulgated, and its text is not public. The Ministry of Manpower's official summary does not mention changes to overtime limits or multipliers. Until the new law and its implementing rules take effect, the calculations on this page follow PP 35/2021.

How is overtime calculated on rest days and public holidays?

Overtime on a weekly rest day (such as Sunday) or a public holiday is paid at higher multipliers, which depend on whether you work a 6-day or a 5-day week (PP 35/2021 Article 31(2) and (3)). The basis is still the hourly wage of 1/173 of your monthly wage. For a 6-day week there is a separate rule when the public holiday falls on the shortest working day.

The hourly wage is 1/173 of the monthly wage (Article 32(2)). On a normal working day: first hour 1.5 times, later hours 2 times (Article 31(1)).

What does a worked example of holiday overtime look like?

These examples use U for your monthly wage, so your hourly wage is U/173. Put in your own wage.

  • 5-day week, 10 hours of overtime on a Saturday or public holiday: hours 1 to 8 pay 8 x 2 = 16, hour 9 pays 3, hour 10 pays 4. The total is 23 x U/173.
  • 6-day week, 8 hours of overtime on a Sunday: hours 1 to 7 pay 7 x 2 = 14, hour 8 pays 3. The total is 17 x U/173.
  • Daily-paid workers on a 6-day week: U is the daily wage times 25; on a 5-day week, the daily wage times 21 (Article 33(1)). For piece-rate workers, U is the average income of the last 12 months and may not be below the minimum wage (Article 33(2) and (3)).

Do I have to work overtime if my manager asks?

Overtime may only be worked with the consent of the worker concerned (Law 13/2003 Article 78(1) as amended by Law 6/2023). PP 35/2021 Article 28 requires the employer's instruction and the worker's written or digital consent, for example a signed list of workers willing to work overtime.

Can overtime be paid with a dinner or transport money instead?

No. Overtime pay is calculated with multipliers of the hourly wage under PP 35/2021 Articles 31 and 32. Food and drink for overtime of 4 hours or more is an extra duty (Article 29) and does not replace overtime pay. Another name may be used if the value is the same or better (Article 34).

Are managers entitled to overtime pay?

Workers in certain job grades, who act as thinkers, planners, executors or controllers of the company with unlimited working time and higher pay, can be excluded.
